The Issue:

Updated: July 2024
Currently, the Democratic Party supports abortion rights and access to reproductive healthcare services, while the Republican Party is generally opposed to late-term abortion and supports policies that may restrict access to late-term abortion, controversial contraceptive methods, and in some instances, abortion in any form.

The legal reality is that the Supreme Court has overturned Roe v. Wade, allowing states to regulate or prohibit abortion.

Relevant Policies:

Supreme Court Rulings:

Democratic Party (DNC)

  • Stance: The Democratic Party supports abortion rights and access to reproductive healthcare services. They advocate for the protection of Roe v. Wade, the landmark Supreme Court decision that legalized abortion nationwide.
  • Policies: Democrats support policies that protect and expand access to abortion services, such as the Women’s Health Protection Act, which would codify the right to abortion into federal law.
  • Viewpoints: Democrats argue that abortion is a fundamental right and a critical component of reproductive healthcare. They believe that the government should not interfere with a woman’s right to make decisions about her own body.
  • Key Figures:
    • President Joe Biden and Vice President Kamala Harris are strong advocates for abortion rights. Biden has stated that he supports codifying Roe v. Wade into law and has taken executive actions to protect abortion access. Harris has been vocal about her support for reproductive rights and has criticized Republican efforts to restrict abortion access.

Republican Party (RNC)

  • Stance: The Republican Party is generally opposed to late-term abortion and supports policies that restrict access to abortion services. They advocate for the protection of unborn life and often refer to themselves as pro-life.
  • Policies: Republicans support policies that restrict abortion access, such as the “Heartbeat Bill,” which bans abortion once a fetal heartbeat is detected (usually around six weeks). They also support the Hyde Amendment, which prohibits federal funding for abortion services.
  • Viewpoints: Republicans argue that abortion is the taking of an innocent life and that the government has a responsibility to protect the unborn. They often frame the abortion issue as a moral and ethical concern.
  • Key Figures:
    • Former President Donald Trump and Ohio Senate candidate J.D. Vance are strong opponents of late-term abortion and are instead, for state’s rights on the determination of abortion legality. Trump has been vocal about his support for the pro-life movement.

Portrayal vs. Legal Reality:

  • Democratic Portrayal: Democrats often portray the abortion issue as a fundamental right and a critical component of reproductive healthcare. They argue that the government should not interfere with a woman’s right to make decisions about her own body.
  • Republican Portrayal: Republicans often frame the abortion issue as a moral and ethical concern, arguing that the government has a responsibility to protect the unborn.
  • Legal Reality: The legal reality is that the Supreme Court has overturned Roe v. Wade, allowing states to regulate or prohibit abortion. This has led to a patchwork of state laws, with some states expanding abortion access and others severely restricting it.

Progressive Perspectives

  1. Right to privacy: Democrats argue that the right to privacy, which is protected by the Constitution, includes a woman’s right to make decisions about her own body, including the decision to have an abortion.
  2. Right to bodily autonomy: Democrats argue that a woman has the right to control her own body and make decisions about her own health, including the decision to have an abortion.
  3. Protecting women’s health: Democrats argue that abortion is a critical component of reproductive healthcare and that restricting access to abortion services can harm women’s health.
  4. Equity and justice: Democrats argue that restricting abortion access disproportionately affects low-income women and women of color, and that it is a matter of equity and justice to protect abortion rights.

Conservative Perspectives

  1. Right to life: Republicans argue that the right to life, which is protected by the Constitution, should be extended to unborn children. They believe that life begins at conception and that abortion is the taking of an innocent life.
  2. Moral responsibility: Republicans argue that the government has a moral responsibility to protect the unborn and that allowing abortion is a moral failure.
  3. Protecting the vulnerable: Republicans argue that the unborn are a vulnerable population that needs protection and that allowing abortion is a failure to protect the most vulnerable.
  4. Family values: Republicans argue that abortion undermines family values and that it is a matter of preserving the traditional family structure to restrict abortion access.
  5. Religious beliefs: Many Republicans base their opposition to abortion on their religious beliefs, arguing that abortion is against the teachings of their faith.
